Key Provisions

• Would speed up investigations into repeated unfair trade practices for the same products.
• Would allow the government to investigate and counter "cross-border" subsidies, where a foreign government helps a company in another country export to the U.S.
• Would let the government consider how foreign governments distort production costs, including through lax environmental or labor law enforcement.
• Would allow the government to investigate if foreign governments take action that contributes to undervaluing their currency to make exports cheaper.
• Would require importers to certify that their goods are not subject to existing anti-dumping or countervailing duties.
