Key Provisions

• Lets the Attorney General stop deportation or allow re-entry for spouses and children of U.S. citizens if their removal would cause hardship to the U.S. citizen family.
• Lets the Secretary of Homeland Security waive certain immigration rules or stop deportation processes for spouses and children of U.S. citizens if their removal would cause hardship to the U.S. citizen family.
• Includes widows and surviving children of deceased U.S. citizens in these new discretionary powers, under similar hardship conditions and time limits.
• Allows people whose immigration cases were previously denied to ask for them to be reopened if they would qualify under these new rules, generally within two years.
• Clarifies that these new powers must be used on a case-by-case basis and do not change other existing immigration laws.
